In this agreement, Ken Austin d/b/a Ken Austin Contracting Services,Inc. hereafter referred to as "we" or "I" offers his property management services to Fname LName, owner of a home located on Street Address, Killington and hereafter referred to as "you", beginning November 15, 2009. In consideration of these services, you agree to pay the following fee: $52 per month.
DESCRIPTION OF SERVICES PROVIDED:
We will make a routine inspection visit to your at least once a week throughout the year. If your unit is occupied when we visit, we will not enter and disturb the occupants unless we have reason to believe some problem exists. We will make additional visits if unusual conditions conditions which could adversely affect your unit, such as unusually cold weather, windstorm, heavy snow or rain, hailstorm, flooding, electrical power interruptions, etc. should occur between routine visits. As routine visits, we will inspect the general interior and exterior condition of your unit, the general condition of furnishings and appliances and ascertain that furnaces, water heaters, water softeners, filters, and other specialized equipment are functioning normally. We will attempt to regulate lighting, heat and hot water so as to best conserve energy. We will furnish you with a report of all such inspections once each month.
DESCRIPTION OF SERVICES NOT PROVIDED:
With the exception of reporting obvious breakage or theft, we will not be responsible for controlling the inventory of fixtures, furnishings, decorations, utensils, tools, or supplies in your home. We will not provide, as part of the
monthly fee, any maintenance, repair, or service work, other that minor items taking no more than 15 minutes to complete and which are required to maintain proper occupancy conditions. We will not provide any maintenance, servicing,
or repairs for spas and hot tubs.
AUTHORIZATION FOR REPAIRS:
If we discover damage or any problem with your home which requires immediate attention to prevent a catastrophe, remedy an unsafe condition or prevent a loss of rental income; you hereby authorize us to have the damage or problem repaired or corrected immediately. If the cost of any such emergency repair is likely to exceed $100., we will make all reasonable efforts to reach you by telephone for authorization. If you are not available for consultation, you hereby authorize us to use our discretion regarding repairs.
Without specific prior authorization we will also have minor damage or problems repaired to maintain the proper condition of the unit for rental occupancy.
If we discover repairs we feel are necessary or desirable but do not meet the criteria above for immediate action, we will notify you and will proceed to arrange these repairs only on your authorization.
If we must spend a significant amount of time arranging for repairs or services in your home, soliciting bids or proposals from outside contractors, or gathering information or your behalf, we will bill you at the hourly rate for time so spent.
LABOR RATES:
If we perform needed repairs in your home, the following rates will apply:
Basic Hourly Rate $40. /hr
Service Call $40.
Service Call After 6 p.m. $45.
Trip Charge $40.
A service call is a special trip to your home to investigate or repair a specific problem which may arise between inspections. If the problem requires more than one hour to correct, you pay the hourly rate after the first hour. A service call after 6 p.m. involves a serious problem which must be corrected after business hours. If the problem requires more than one hour to correct, you pay the overtime rate after the first hour. If we must make a special trip out of the Killington area for parts or supplies in conjunction with an emergency repair, a trip charge is added in addition to the hourly rate.
SERVICE CHARGE:
Service or repairs performed by our own employees will be subject to a 10% service charge on materials. Service or repairs performed by outside contractors will be subject to a 10% service charge to cover our office costs for arranging, monitoring, and paying for the work for you.
BILLING:
Bills will be rendered on a monthly basis and are payable within 10 days of receipt of same. A finance charge or 1% per month on accounts overdue by thirty (30) days or more will be imposed.
OWNERS RESPONSIBILITY:
You agree to maintain your home and all furnishings, appliances, equipment and systems in a safe, serviceable, sanitary, and working condition. To this end, you agree to have furnaces, fireplaces, flues, and woodstoves inspected and serviced annually. You must furnish smoke detectors and at least two charged fire extinguishers for the safety of the occupants. You must provide accessible animal-proof outdoor trash containers large enough to store a week's accumulation of trash. You must maintain clear and safe access to your house.
AGENT'S RESPONSIBILITY:
In acting as your agent, we agree to use our best effort and experience to represent your interest in matters regarding your home. We agree to secure or furnish services in a timely and cost effective manner.
DISCLAIMER:
Ken Austin d/b/a Ken Austin Contracting Services, Inc. shall not be held responsible or liable for acts of negligence, theft, or other damage to your home as a result of the rental thereof. Furthermore, you recognize that we are in no way liable for and shall not be held responsible for any costs, damages, expenses, or injuries arising out of any cause whatsoever in connection with the management of your home, and you agree to indemnify and save harmless Ken Austin d/b/a Ken Austin Contracting Services, Inc. against all costs, expenses, suits, liabilities, and damage arising from or connected with the management of your property by Ken Austin d/b/a Ken Austin Contracting Services, Inc.
Also Ken Austin d/b/a Ken Austin Contracting Services, Inc. will not take responsibility for inherent defects in the house and damage which may occur from them such as but not limited to: inadequate insulation, flashing defects, hard-to-close doors or windows, problems with chimney, electrical, plumbing, structural, roofing systems.
